Terms of Service

These Terms govern your use of CarCast, operated by CarCastAI, LLC (“CarCast”, “we”). By creating an account or using the service, you agree to these Terms. Read them carefully.

1. The service

CarCast publishes AI-generated price forecasts and trend classifications for used vehicle segments. The service includes the marketing site, the dashboard, alerts, market-trend pages, and any related APIs we expose.

2. Forecasts are informational analytics — not financial advice

CarCast's forecasts and trend classifications (Rising / Stable / Softening) are informational analytics generated from historical and current market data. They are not financial advice, investment guidance, or a recommendation to purchase, hold, or sell any vehicle. Forecasts have inherent uncertainty. We publish P10 / P50 / P90 confidence bands so you can see the range of likely outcomes. Individual market conditions vary; your actual transaction price may diverge from the forecasted median.

You make your own buy/sell/hold decisions. CarCast is not liable for transaction outcomes, gains, or losses based on use of the forecasts.

3. Account and eligibility

You must be at least 18 years old to create an account. You are responsible for the security of your credentials and for all activity under your account. Notify us immediately if you suspect unauthorised access.

4. Subscription, billing, refunds

  • Free plan is available indefinitely with no credit card required.
  • Pro and Agency plans are billed monthly via Polar. Subscriptions auto-renew until cancelled. Cancel any time from your account settings or via the billing portal — access continues until the end of the current billing period.
  • Pro free trial is 7 days and requires a card on file. Cancel before the trial ends to avoid charges.
  • Refunds. We process refund requests on a case-by-case basis when raised within 14 days of charge. Email us via /contact with the order ID.
  • Pricing changes.We may change pricing with at least 30 days' notice. Existing paying subscribers get the change at next renewal.

5. Acceptable use

You agree not to:

  • Reverse engineer, scrape, or attempt to derive the underlying model.
  • Resell, sublicense, or redistribute forecasts beyond your own internal use without a separate written agreement.
  • Misrepresent CarCast forecasts as financial advice or as independent third-party valuations to consumers.
  • Use the service to harass, defame, or harm any person.
  • Probe, attack, or attempt to bypass rate limits, authentication, or other security controls.
  • Submit content that infringes any third party's rights.

Violations may result in suspension or termination without refund.

6. Intellectual property

CarCast, including the website, forecasts, dashboards, blog posts, design, and software, is owned by CarCastAI, LLC and protected by copyright and other laws. We grant you a limited, non-exclusive, non-transferable licence to use the service for your own legitimate purposes. Open-source dependencies are listed on /attributions.

7. User-submitted content

Vehicle requests, alerts, and other content you submit remain yours. You grant us a non-exclusive, royalty-free licence to use that content to operate and improve the service. We will not publicly attribute submissions to you without permission.

8. Third-party services and data

The service depends on third-party data providers (MarketCheck, BLS / FRED, Manheim) and third-party infrastructure (Polar, Clerk, Neon, Fly, Vercel, Resend). We don't control their uptime or content. Disruptions in their services may affect ours. Their individual terms apply where their services are used.

9. Disclaimer of warranties

The service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that forecasts will be accurate, complete, or uninterrupted.

10. Limitation of liability

To the maximum extent permitted by law, CarCastAI, LLC, its officers, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or business interruption — arising from your use of or inability to use the service. Our aggregate liability is capped at the greater of (a) the fees you paid us in the 12 months preceding the claim, or (b) one hundred US dollars (USD $100).

11. Indemnification

You agree to indemnify and hold harmless CarCastAI, LLC from any claim arising out of your breach of these Terms, your use of the service in violation of any law, or any content you submit.

12. Termination

You may close your account at any time. We may suspend or terminate accounts that violate these Terms or pose a risk to other users or to the service. On termination, your access ends and provisions that by their nature should survive (IP, liability limits, governing law) survive.

13. Governing law & disputes

These Terms are governed by the laws of the State of Ohio, USA, without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Cuyahoga County, Ohio. Both parties consent to personal jurisdiction there. Where required by applicable consumer-protection law, you may instead bring claims in the small-claims court of your county of residence.

14. Changes to these Terms

We may revise these Terms over time. Material changes will be announced via email at least 30 days before they take effect. Continued use of the service after that constitutes acceptance.
